These Terms and Conditions govern all aspects of your use of PoolApp. These Terms and Conditions apply to the Pool Captain (also referred to as “you” or “your” in these Terms and Conditions), acting in the Pool Captain’s own right as well as the Pool Captain acting on behalf of members of the Pool Captain’s group, and each member of the group. A Pool Captain is the main administrator of the group and is responsible to ensure that all members of the pool are nineteen(19) years of age or older. By using PoolApp in any manner, you agree that you have read and agree to be bound by these Terms and Conditions. If you do not accept any of these Terms and Conditions or you do not agree to be legally bound by them, do not use PoolApp.
PoolApp and the information contained in PoolApp are made available by the Atlantic Lottery Corporation (“ALC”) solely for the convenience of lottery group players (also known as “lottery pool players”) in Atlantic Canada aged 19 or over. Use of PoolApp is provided on an “as is” and “as available” basis solely to assist in facilitating communication between lottery group members.
ALC assumes no responsibility whatsoever for the entitlement, or not, to any prize of any group or group member or in any way related to any dispute of whatsoever nature or cause arising from the use of PoolApp or for the accuracy of any of the information at any time contained in the PoolApp application. Unauthorized use of the information contained on PoolApp is strictly prohibited. All group members must be 19 years of age or older. By using or attempting to use PoolApp, you certify that you are at least 19 years of age and that all members of the lottery group/pool are at least 19 years of age and meet any other eligibility requirements.
PoolApp is a beta test that ALC is operating in a pilot mode. ALC reserves the right to end this pilot at any time for any reason.
PoolApp requires the following from the Pool Captain to register an account for a lottery group: full name, email, province of residence and confirmation that the Pool Captain is at least 19 years of age. The Pool Captain will be required to use an email account and choose a unique password. It is your responsibility to keep your password confidential and secure. Only you are permitted to access and use your password. You will be solely responsible for any use or misuse of your password by any person. ALC is not liable for any access to or use of PoolApp, including arising from unauthorized use of your password. You agree that ALC shall be entitled to assume that any user of PoolApp who enters the correct combination of your email and password is you and that any transaction involving your Account has been undertaken by you and is valid.
While reasonable efforts are made to ensure the accuracy of the information on PoolApp, no warranty of accuracy or completeness is expressed or implied. Also, information may be changed or updated without notice. You should refer to ALC's official lottery results, official game instructions and rules, which override any information contained on PoolApp.
ALC may, in its sole and absolute discretion, amend these Terms and Conditions from time to time without prior notice to you. You are responsible for familiarizing yourself with the Terms and Conditions from time to time, and each time you use PoolApp, you will be deemed to confirm your agreement with and acceptance of the Terms and Conditions in effect at such time. If at any time you are requested by ALC to confirm your acceptance of and agreement with the Terms and Conditions then in effect and you do not do so, your Account will be suspended.
The contents of PoolApp, including all software, design, text, images, photographs, illustrations, audio and video material, artwork, graphic material, databases, proprietary information and all copyrightable or otherwise legally protectable elements of PoolApp, including, without limitation, the selection, sequence and 'look and feel' and arrangement of items, and all trademarks, service marks and trade names (individually and/or collectively, “Material“), are the property of ALC, under Canadian, as well as applicable foreign laws, regulations and treaties. PoolApp is to be used solely for your non-commercial, non-exclusive, non-assignable, non-transferable and limited personal use and for no other purposes. You must not alter, delete or conceal any copyright or other notices contained on PoolApp, including notices on any material you download, transmit, display, print or reproduce from PoolApp. You shall not, nor will you allow any third party (whether or not for your benefit) to reproduce, modify, create derivative works from, display, perform, publish, distribute, disseminate, broadcast or circulate to any third party (including, without limitation, on or via a third party website), or otherwise use, any material without the express prior written consent of ALC. Any unauthorized or prohibited use of any material may subject you to liability, prosecution, or both, under applicable federal, provincial and local laws. We require users to respect our copyrights, trademarks, and other intellectual property rights. We likewise respect the intellectual property of others. On notice, we will act quickly to remove content on PoolApp that infringes the copyright rights of others and will disable the access to the application and its services of anyone who uses them to repeatedly to infringe the intellectual property rights of others.
Atlantic Lottery hereby grants you the limited right to access, view and use PoolApp only for the purposes of accessing and using PoolApp. ALC reserves the right to suspend or deny, in its sole discretion, your access to all or any portion of PoolApp. This license is limited to personal and non-commercial uses by you. Any rights not expressly granted to you herein are reserved to ALC. Unless you have received specific written permission from ALC, you may not (a) alter or modify any content on PoolApp; or (b) deep link or gain unauthorized access to any portion of PoolApp. Without limiting other restrictions, you agree not to reproduce, transmit, sell, or otherwise exploit PoolApp for any commercial purpose.
From time to time, ALC may conduct promotions through PoolApp, including, without limitation, contests and sweepstakes. Each promotion may have additional terms and/or rules which will be posted or otherwise made available to you and, for purposes of each promotion, will be deemed incorporated into and form a part of this agreement. You can opt-out of receiving offers and promotions at any time by unchecking the “Send me offers & promos” checkbox in the Profile & Settings section of PoolApp.
ALC can discontinue PoolApp at any point in time in its sole discretion.
PoolApp, and all materials, products and postings are made available on an “as is“ and “as available“ basis, without any representation or warranty of any kind, express or implied, or any guarantee or assurance PoolApp will be available for use, or that all products, features, functions or operations will be available or perform as described. ALC expressly disclaims all representations and warranties of any and every kind, express or implied, with respect to any and all products, including, but not limited to, any warranty of merchantability or of fitness for a particular purpose. In no event or circumstance is ALC, its shareholders, officers, employees or agents, liable, whether in contract, tort or any other principle of law, for any losses or damages of whatever nature, including, without limitation, any damages for loss of the opportunity for potential lottery prizes (or to receive other things of value, or any other opportunities of any kind, loss of programs or other data, arising in any manner from (i) the use of PoolApp, (ii) modification or discontinuance of PoolApp or (iii) from any errors, omissions, inaccuracies, or any misleading or out-of-date information, whether contained on PoolApp or as otherwise received by the user of PoolApp, even if ALC, its officers, employees or agents were aware or should have been aware that such loss or damage could occur.
Without limiting the foregoing, we are not responsible or liable for any malicious code, delays, inaccuracies, errors, or omissions arising out of your use of PoolApp. You understand, acknowledge and agree that you are assuming the entire risk as to the quality, accuracy, performance, timeliness, adequacy, completeness, correctness, authenticity, security and validity of any and all features and functions of PoolApp, including, without limitation, postings and materials associated with your use of PoolApp.
You agree to indemnify, defend and hold ALC, and any of its officers, directors, employees, agents, representatives, advertisers, suppliers, and operational service providers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable attorneys' fees), resulting from any breach or violation of these Terms and Conditions by you.
Use of PoolApp is subject to “General Conditions for Users of ALC Sites (“General Conditions”)” and “ALC’s Online Privacy Notice” which are incorporated by reference into these Terms and Conditions. Please review these on ALC.ca before using PoolApp and agreeing to these Terms and Conditions. Information collected by ALC during the registration process is used for customer validation purposes and to contact selected account holders to obtain feedback on PoolApp. ALC will review pool information and activities to identify ways to improve PoolApp. Data will be stored on ALC hardware in the ALC data center. Except as expressly stated otherwise, any notices required or allowed under these Terms and Conditions shall be given to Atlantic Lottery by postal mail to: Atlantic Lottery Corporation 922 Main St, Moncton, NB, E1C8W6, or as to a successor address that Atlantic Lottery makes available on PoolApp or through other reasonable manner.
